Prohibited Weapons Policy

Policy Statement

The possession, transfer, sale, or use of weapons, dangerous instruments, or paraphernalia associated with a weapon is prohibited on Duke-owned or leased premises (even for those licensed to carry a weapon). This restriction includes, but is not limited to, parking lots, personal vehicles, Duke-sponsored events, and Duke-owned vehicles.

Possession of weapons is prohibited at all times while conducting Duke business - except as may be required as a condition of employment. Violation of this policy may result in corrective action up to and including termination. Where appropriate, Duke Police will report the transfer, sale, or use of weapons or dangerous instruments to local law enforcement authorities.

Definitions

Duke prohibits any weapon, including, but not limited to:

  • Firearms (including concealed handguns, and BB guns, whether loaded or unloaded);
  • Knives (including switchblades, stilettos, swords, etc.);
  • Police batons or nightsticks;
  • All martial arts weapons; and
  • Electronic defense weapons.

A "dangerous instrument" is defined as any instrument, article, or substance that, under immediate circumstances, is capable of causing death or physical injury.

Any staff member who has a question as to whether an instrument, article, or substance is considered a weapon or dangerous instrument in violation of this policy should ask for clarification from their supervisor, entity, or departmental HR representative or a Staff and Labor Relations representative prior to bringing the instrument, article, or substance on Duke-owned or leased premises.

Exceptions to the weapons policy must be approved beforehand by a representative of the Duke Police Department. Any weapon or dangerous instrument on Duke-owned or leased premises may be confiscated. There is no reasonable exception of privacy with respect to such items in the workplace. Staff members’ desks, workstations, offices, lockers, bags, briefcases, files, etc. may be subject to security searches.
