FMLA for Campus Employees

Family Medical Leave (FMLA)

A staff member who has been employed at Duke University and/or Health System for at least 12 months (need not be consecutive), and has worked at least 1250 hours during the preceding 12 months, is eligible for this type of leave.

For staff members who have less than one (1) year of service or less than 1250 hours worked within the 12-month period. Illness/injury leave and/or maternity leave are available for an event that would normally qualify for FMLA. FMLA must be taken prior to transitioning to either of these types of leave if the staff member is eligible for FMLA and the absence is an FMLA qualifying absence. FMLA is available for the following reasons:

  • Birth of a child
  • Adoption or placement of a foster child (within 12 months of the child being placed in the home)
  • Staff member's own serious health condition
  • Serious health condition of a dependent child, parent or spouse/registered same sex spousal equivalent for whom the staff member is the primary caregiver.
  • Care for injured or ill service member (Military Family Leave)

A staff member who takes this type of leave, at the end of initial leave period, will normally return to his/her former position. However, if that position had to be filled with another regular staff member, the department will place the staff member in another position of equal pay and status.
